NSW Parliamentary Gift Shop Terms and Conditions

These terms govern the sale of products by The Legislature, trading as NSW Parliamentary Gift Shop. Please read the terms carefully. Placing an order with NSW Parliamentary Gift Shop indicates acceptance of these terms. NSW Parliamentary Gift Shop reserves the right to amend these terms as required. Amendments take effect when posted on the gift shop web site (“the Site”), and apply to all orders placed subsequently.

These terms form a binding contract between NSW Parliamentary Gift Shop and any person who orders a product using the Site (“the customer”). If as a customer, you are under 16 years of age, you will need to ask your parents or guardians to place an order for you.

On placement of an order for a product, the customer agrees to pay the price specified in the order, including the delivery costs advised by NSW Parliamentary Gift Shop. Subject to payment in full, and subject to these terms, NSW Parliamentary Gift Shop agrees to supply the product to the customer and to arrange delivery of the product to the delivery address specified in the order at the time of purchase.

Taxes, Duties & Charges

Pricing is expressed in $AUD and inclusive of Australian GST. The customer is responsible for any other taxes, duties and charges imposed on products ordered including in particular to import duties imposed by countries other than Australia.

Returns & Exchanges

The customer may return a product within 21 days of receipt provided that: (a) they contact NSW Parliamentary Gift Shop within 7 days of receipt (b) the customer returns the product within 21 days of receipt (c) the returned product is in saleable condition, unused, unwashed, unworn and undamaged, and in its original packaging in original condition including (if applicable) dust bags, boxes, plastic wrap, garment and security tags and gift boxes. Except in the case of product defects.

If the customer returns a product in accordance with the above terms, NSW Parliamentary Gift Shop will refund the price paid, less delivery costs and any other taxes, duties or charges imposed in respect of the product. If the product was a gift or a sale product, the refund will be by way of NSW Parliamentary Gift Shop credit. If the customer returns a non-sale product in accordance with the above terms and request an exchange for a different size, and stock in the requested size is available. Products returned other than in accordance with the above terms may be refused and sent back to the customer at a cost to the customer. The customer is responsible for returns items until delivered to NSW Parliamentary Gift Shop. The customer must contact NSW Parliamentary Gift Shop in advance with details of returns.

The NSW Parliamentary Gift Shop may refuse to provide a free repair, replacement or refund if:

  • (a) the customer simply changed their mind
  • (b) the customer misused the product or service in a way that contributed to the problem
  • (C) the customer asked for a service to be done in a certain way against the advice of the business or were unclear about what they wanted or a problem with a service was completely outside of the NSW Parliamentary Gift Shop control.

 

Defective Products

A defective product is a product that is not of merchantable quality, does not correspond with its description, or where a defect in materials or workmanship becomes apparent to the customer and is notified to NSW Parliamentary Gift Shop within 21 days of receipt.

Products damaged by accident or misuse (for example, being dropped), by use other than in accordance with their specifications (for example, improper cleaning), or by normal wear and tear, are not defective. Furthermore, because the performance of computer monitors varies, the actual product item colour may differ slightly from the colour the customer will see on their individual digital devices. Differences of that nature are not product defects.

NSW Parliamentary Gift Shop will pass on to the customer the benefit of any manufacturer’s or distributor’s warranty in respect of products ordered by and supplied to the customer. In some cases, the customer will need to follow directions included with the product (for example, product registration) to obtain the benefit of the warranty. Claims under those warranties should be directed to the manufacturer or distributor concerned.

Before returning a defective product, the customer must notify NSW Parliamentary Gift Shop of the details and reason for the return. Where practicable, NSW Parliamentary Gift Shop will arrange for the repair of defective products. If a product cannot be repaired, NSW Parliamentary Gift Shop will provide a refund of the price paid, including delivery costs.

The NSW Parliamentary Gift Shop liability to the customer in respect of defective products is limited to repair of the product or refund of the purchase price and delivery costs originally paid by the customer.

These terms are intended to be read consistently with the customers legal rights as a consumer under NSW State law and Australian law. Those rights take precedence over these terms to the extent of any inconsistency between them. To find out more, please visit the NSW Fair Trading website. 

Gift Certificates and NSW Parliamentary Gift Shop Credits

Gift certificates are sent to the recipient by email once payment has been processed. Gift Certificates and NSW Parliamentary Gift Shop credits are valid for three years from the issue date, are not refundable and cannot be exchanged for cash or NSW Parliamentary Gift Shop credit.

Sale of Alcohol

It is against the law to sell or supply alcohol to, or obtain alcohol for, anyone under 18. Identification must be provided when collecting alcohol.
